The project will be completed in 36 months with an investment of 300 crores.

The Inorbit mall will overlook the Durgam Cheruvu. Anand Sundaram, Vice President, design and planning, says, "Among the metros, Hyderabad has the maximum potential for growth. It is investor friendly and there's market waiting to be tapped. People in Hyderabad and Bangalore are movie lovers so multiplexes become an integral part of their lifestyle. The society will shortly open a 40,000 square feet Handloom House mall in Hyderabad, according to Mr Rahmatullah Ansari, President. The mall in Hyderabad, built on land provided by the Andhra Pradesh Government, will be like any other modern shopping complex, Mr Ansari told Business Line. The effort will be to enable shoppers to meet all their apparel and household furnishing needs under one roof, he added. "The store will cater to the needs of the entire family and will also have refreshment facilities."

Don't Let Glitz Blind You - Realty Ad"wise"

The brochures are glossy and the tele-callers are masters in sweet talk. But before you invest in realty, check and doublecheck.

Caught in a realty frenzy, one find himself/herself bombarded with offers, offers and more offers. Whether you are interested or not, there is no dearth of realtors, brokers and agents who spare no efforts to impress with virtues of their project. Pamphlets are dropped at home, tele-callers keep calling on your landline and mobile, glossy brochures are handed out, advertisements stare at you and hoardings are hard to miss at main junctions.

Your investment doubles in just few months, one says. Ours is the venture you should put the hard earned money, another screams. Miss out and you will regret, yet another seek to caution. From heart of the city to the distant and some never-heard-before locations, plots and houses are offered with enticing details. Just next to airport coming up at Shamshabad, very close to Fab City, along the Outer Ring Road and so on. Hard to ignore. But where actually are they located need to be verified.

Do not get swamped by the blitz. Take a closer look at all the glitzy publicity material and try to check the same on ground. A personal visit to the site and some time spent with authorities concerned with approvals and registration will give insights that you might otherwise miss out. Check the credibility of developers and never hesitate to enquire about their earlier ventures. And if possible, do visit the same and find out whether promises were kept or not.

Advocate's advice
If your not sure about title details and registration details, rope in the services of an advocate. A small retainer at this stage might save you from a huge loss. Do not allow yourself to be hurried for the agents and brokers try to push you into the deal with a standard, "prices here are going to rise sharply in a week or fortnight's time".

Golconda Fort To Host International Event On Diamonds

Andhra Pradesh’s Golconda fort will play host to an international event on diamonds. Diamond Trading Company (DTC), a De Beers Group company, will be organising this event at the historical monument in March 2007 for the first time in India.

Golconda fort, which is about 11 km from Hyderabad, was once famous for diamond trade. Besides, the world-famous ‘Kohinoor’ diamond is said to have its origins here. “Because of the history that the Golconda fort shares with diamonds, we have decided to organise an international event on diamonds here,” Cherie Tandon Saldanha, managing director-India, DTC, told mediapersons in Hyderabad.

Called ‘Celebrating Diamonds-Myths and Magic’, the event is being organised to promote the consumption of diamonds internationally. Auctioning of diamonds will also take place at the event. Last time, a similar event was organised in Venice.

According to Saldanha, the jewellery market in India is around Rs 68,000 crore of which diamond jewellery comprises around Rs 8,000 crore.

AP devises unique formula to beat land shortages

The AP Government has cleared plans for 14 SEZs due to come up near Hyderabad. It expects investment of over USD 10 billion here. But it also needs 22,000 acres of land to realise this ambitious plan. Now it might have hit on a solution.

The government will give landowners, who are farmers, two choices. First, a farmer can become a revenue shareholder in the finished project. Alternatively, he can have a portion of the land returned to him after the government develops it. This includes building roads, water, drainage and electricity. This would boost the value of the land, especially when it includes plans for mega projects.

Chief Minister YSR Reddy says,” In an around Hyderabad quite a few SEZs are being planned. Besides, ONCG is planning a SEZ in Kakinada for 10,000 acres, Nelur and Chitur districts will also have SEZs. So all these areas will come up."

A joint development model will first be used in Uppal, outside Hyderabad. The Hyderabad Urban Development Authority is acquiring 830 acres of land here. Farmers will be given 50% partnership in the proposed project.

The value of land in this region has appreciated 12 times in the past year since the government began to show interest. It's likely then that farmers who until now were opposed to the governments development plans will become much more enthusiastic. That's a solution that might please everybody.

Gulf Oil Corp mulls IT park in Hyderabad

Gulf Oil Corporation, a Hinduja group company is planning to set up either a biotechnology or an IT park in Hyderabad, entailing an investment of around Rs 500 crore.

CNBC-TV18 has learnt that construction for the IT park would begin by 2006 end. The total development area is likely to be 800 acres. 50% of the area has been acquired in the last 30-40 years and 50% of the area is leased.

Further, the project is expected to be completed in 2-3 years time. It will be financed through a mix of GDR and other financial issues. The park will be either sold outright or leased. Cushman & Wakefield are the consultants for the project.

Major Aspects Of Rent Agreement

In case you are giving your home on rent or taking a home on rent, the rent agreement plays a pivotal role in determining the rights of the lessor and lessee. The rent agreement, entered into between the lessor and the lessee , is the agreement that contains the terms and conditions subject to which the property has been leased by the lessor to the lessee.

Before entering into a lease agreement, the lessee should ensure that the lessor has proper title of the property. The lessor should either be the owner of the property or an authorised power of attorney holder. The lessee may verify the society share certificate in order to ensure that the lessor has the title to the property. The agreement should be signed by the lessor himself or his duly authorised power of attorney.

Common clauses contained in a rent agreement are related to:
1. Details of the lessor and the lessee and their addresses
2. Details of property leased - its location and identification details
3. Declaration by the lessor that he is either the owner of the property or is duly authorised by the owner to give the property on lease
4. The effective date of commencement of the rent agreement and duration 5. Term of the lease
5. The lease rent and the mode of payment
6. Security deposit amount paid, and whether it is interest-free or not and the circumstances when it is refundable
7. Advance rent payable, if any, and the mode of its adjustment
8. Rent increment clause - when the rent can be increased and at what rates
9. Facilities to be included in the rent - Who has access to the common area, garden area etc
10. Payment of municipal dues, property and house taxes
11. Maintenance charges to be paid to the society
12. Routine repair and maintenance expenses of the house
13. Fixtures and fittings to be provided by the lessor or not
14. Grounds of termination of the agreement
15. Notice period required for termination of the lease
16. Registration expenses of lease deed
17. Renewable clauses
18. Details of parking space
19. Details of terrace rights
20. Details of society entry charges payable

The other terms would depend upon the commercial terms which have been agreed to between the parties . There is no prohibition under any statute as to the number of years a lease can be given by the lessor to the lessee. Under the Registration Act, leases of property of more than one year need to be registered. The stamp duty payable depends on the rates prevailing in the respective States.

Hyderabad's "HOT" Places Series - Khairatabad

This area is well known for Hyderabad’s biggest Ganesh idol, its association with the culture of Old Hyderabad, is an extension of the bureaucratic Raj and is also the constituency that has changed the destinies of political parties. However, owing to its proximity to the emerging commercial hub of Hyderabad, it has managed to blend modernity and traditionalism perfectly. Over the past five years, Khairatabad has metamorphosed to become an essential link between the old part of Hyderabad and the more modern areas of Banjara Hills and Jubilee Hills.

Khairatabad got its name from Khairunissa, a noble lady who married James Achilles Kirkpatrick, an officer in the East India Company in the late eighteenth century. In fact, Khairunissa’s tomb still exists in Khairatabad. Initially it was a completely residential area, developed by the employees of the Accountant General’s (AG’s ) office and the LIC. Prominent colonies here include Anand Nagar Colony, Banjara Avenue Colony, Venkataramana Colony, Padmavati Nagar, Naveen Nagar and Erramanzil , areas that were once dominated by Telugu Brahmins but gradually acquired cosmopolitan hues.

PROPERTY VALUES
Property rates in Khairatabad are sky high, thanks to recent real estate boom in Hyderabad. Raja, manager of RS Realtors says,“Because of its proximity to Banjara Hills, Khairatabad’s real estate rates have shot up. Often, those who cannot find houses or rooms for rent in Banjara and Jubilee Hills, opt for Khairatabad instead.”

Like many others in the city, those who have invested in independent houses are raking in money. The capital value of a 1000 sft independent house was Rs 15 – 25 lakhs four years ago, now it has more than doubled . The recent trend here is to rent out small portions of independent homes. Rates are high - some charge Rs 5000 per month for a 400 sft space.

Another trend is the development of independent houses, especially adjoining ones, into apartments, so much so that hardly any independent houses can be spotted. Satyababu, a builder in Khairatabad says, “Yes, there are lots of residential projects happening in this area. We take land from owners of independent houses on 50-50 basis or complete purchase.” The present rule says that on an area of 2500 sq metres and 100 ft road, one can get permission to go up to 50 metres in height. This is easier if we get the land of two adjoining houses, he adds. Property acquisition is limited to second sales as there is no land available.

Khairatabad has its share of positives and negatives . Khairatabad is presently a very crowded area. However, there is still some quiet when one enters the residential areas.” With MMTS now making a stop at Khairatabad, it is even easier for commuters who travel to farther areas . Botanical Gardens - A Place To Relax
Acres and acres of undulating landscape filled with a dazzling array of colours. Vast stretches of green grass get dotted with carefully nurtured thickets, tall trees and pristine water bodies. This is the true picture of the 120 Acre Hyderabad Botanical Gardens at Kothaguda near Hitec City, which is the first to come up in Andhra Pradesh.

Botanical Gardens is established in Kothaguda Reserve Forest near Hitec City, jointly by the State Forest and Tourism departments, both as eco-tourism project and for growing plants for scientific, educational and aesthetic purposes. The Garden would comprise of all major varieties of Plant Kingdom and some rare species too. It was inaugarated on August 05, 2001.

The Botanical Gardens serves as a sight seeing place providing scientific knowledge about different plants and trees to the visitors. After finishing a stroll in the Garden you will call the Neem plant as Azadiracta indica and Custard Apple as Annona squamosa. Almost all the plants in all sectors provided with nameplates having the common names along with scientific names.

Private Sector participation is approved by the Givernment in developing the Hyderabad Botanical Gardens. A memorandum of understanding is reached between Andhra Pradesh Forest Development Corporation (APFDC) and the city-based De Laraa Estates Limited. The MoU, singed as a `Design Build Finance Operate' (DBFO) model, will have De Laraa investing Rs. 21.39 crores for developing various botanical sectors and species apart from visitor amenities in the 120-acre garden.

The Botanical Garden presently has five sectors and another 15 sectors including medicinal, ornamental, aromatic and zodiac plant sectors are to be developed. The amenities planned include stay facilities in the Live-in Nature sector, underwater wonders, water fountains, herbal health cure, amphitheatre, joggers bund, eco-club for nature lovers with fitness centre and children's park. Efforts are on to identify, collect and grow some 5,000 different species of plants in different sectors of the sprawling garden.

Meanwhile, the APFDC has entered into an MoU with Trac India for developing a Night Safari Park alongside the Hyderabad Botanical Gardens and sent the Rs.60 crore proposal to the Central Zoo Authority.

"Aero Park", Another Jewel In The Crown Of Greater Hyderabad

An "Aero Park" on the lines of the 'IT and knowledge' Parks, catering to aerospace and aeronautics requirements, is proposed to be established near the Hyderabad International Airport under the aegis of the Federation of Andhra Pradesh Small Industries Associations. This would come up in around 500 acres of land with an investment of Rs 300 crore in the next three years to boost the aviation industry and allied sectors. Mr Saraswat said the park would be set up with the public and private partnership (PPP) in which about 50 aerospace manufacturing industries would participate as share holders. It would manufacture spare parts and also provide logistic support to airlines.

Mr. V.L.N. Reddy, President of FAPSIA, said the project was expected to take off in a year's time and the details would be worked out with various government departments for allotment of 200 acres. Hyderabad had emerged as a major centre in the production of various components and sub-systems required for aerospace projects by more than 60 units, with an annual turnover of around Rs. 150 crores. About 100 units were expected in the proposed park with a total investment of about Rs. 250-300 crores.

Chief Minister Y.S. Rajasekhara Reddy declared the Government's support to the aero park project after receiving a memorandum on the proposal. Welcoming the need for setting up the park, he said he was convinced that the Government should take the lead in this regard. The Chief Minister expressed confidence that the growth rate in all sectors would cross the double-digit mark in the near future and called upon the industry to be part of it. He urged more industries to set up units here.

The proposed Aero Park can be a point of convergence with many International Aerospace Companies including Snecma, Airbus, Safran, Boeing and British Aerospace setting up their operation in India, defence analysts said. The Aero Park will be on the lines of the ''IT Park'', 'Knowledge Park', 'Jewellery Park' and 'Garment Parks' and would cover both aerospace and aeronautic industries. The entrepreneurs are likely to cover high quality mechanical, electrical, electronics, microwave and service areas.

With the new Hyderabad International Airport underway, the AeroPark will not only attract new industries but also be a centre of excellence for 'AeroSpace', as it can leverage the SSIs and SMEs around Hyderabad, the analysts said.

Cyber Labs In Hyderabad To Counter Cyber Crime

As a way of enhancing cyber security and to throw light on increasing cyber crime, the National Association of Software and Service Companies (Nasscom) is setting up "Cyber Labs" in Hyderabad, Pune and Bangalore.

Nasscom is in talks with State Bank of Hyderabad and Andhra Bank for setting up of cyberlabs in the city, which requires an estimated amount of Rs 35 to Rs 40 lakhs for a period of two years.

The escalating, hi-tech world of cyber crimes in India is taking the police force back to the classroom. And helping them in their endeavour are Indian IT companies, who are not only holding workshops to train cops in cyber-sleuthing techniques but also providing them with state-of-the-art gadgets to fight crime on the Net.

What started as an experiment in Mumbai in March this year will soon be replicated in other cities, says the National Association of Software and Service Companies (Nasscom), the IT industry umbrella group.

Nasscom joined forces with Mumbai Police to launch the first of its kind "Mumbai Cyber Lab" that helps train police personnel, creates an interface between the police and people, and spreads awareness about cyber crimes. A state-of-the-art virtual private network, connecting over 150 police stations in the city, is also likely to be set up soon to facilitate exchange of information online, said Mehta.

It was a huge success and the model is now being replicated in other parts of the country. "The only way for a law enforcing agency to catch a cyber criminal is to become a master in their game."

Exclusive Hotel Zone Planned At Shamshabad Airport

HYDERABAD: The Hyderabad Urban Development Authority has decided to develop an exclusive hotel zone in its layout near Shamshabad International Airport.

Though HUDA originally proposed the 150-acre land as a residential layout under the Sites and Service scheme, in view of its proximity to the international airport, it was now considered ideal for a group of star hotels, according to Chairman D. Sudheer Reddy.

As in Mumbai, where prestigious hotels were located closer to international airport, big chunks of land measuring 15 acres to 25 acres would be earmarked for five to six hotel projects. The plots in the layout, just 2 km away from the international airport, would be allotted through auction and Request for Proposal would be invited after firming up the proposal, he said.

HUDA Golden Mile Auction Update - Sold At A Whopping Rate

HYDERABAD: The Golden Mile layout at Kokapet in Rajendranagar mandal has indeed turned out to be a gold mine for HUDA. It has literally rained crores as big names vied to outbid one another, making HUDA earn a whopping Rs.703 crores from 15 plots.

Thanks to good marketing and inherent locational advantage, the layouts abutting the Outer Ring Road and close to the Financial district and IT hub, Thursday's auction saw a five acre plot bid for Rs.14.45 crores per acre, the highest among the plots put up for auction. The plot was bagged by city-based Kailash Ganga Constructions. While the HUDA set an upset price of Rs.4.5 crores per acre, the lowest amount bid for a plot was Rs. 6.1crores. The average price worked out to over Rs.10 crores per acre.

The Golden Mile layout marketed as an exclusive development zone for major corporate projects attracted reputed names in real estate and hotel groups like Prestige Gardens Estate Group from Bangalore, Today from Delhi, My Home Constructions Pvt. Ltd, Hyderabad, Lake Point Builders, Mumbai, Madhucon Properties among others.

As many as 47 bidders participated in the auction by paying an Earnest Money Deposit of Rs. 2 crores. The auction passed off without a hitch unlike last time.

HUDA Secretary and auction officer Venkatram Reddy clarified in the very beginning that filing sealed tenders was optional and they would be opened in the presence of all only after open bidding for each plot. If the amount in sealed tender was higher, it would be taken as the final bid.

The very first plot auctioned went in favour of sealed tender when Pioneer Telafone Ltd. of Viceroy group quoted Rs.10.01 crores per acre while the highest open bid for the same plot was Rs.8.15 crores per acre.

Marriott International Inc Plans a New COURTYARD-BRANDED Hotel In Hyderabad

Marriott International, Inc.(NYSE: MAR) is a leading worldwide hospitality company. Its heritage can be traced to a root beer stand opened in Washington DC, in 1927 by J. Willard and Alice S. Marriott. Today, Marriott International has nearly 2,800 lodging properties located in the United States and 66 other countries and territories.

Marriott is to open a Courtyard-branded hotel in Hyderabad, India, in 2009 under a management agreement reached with an affiliate of Viceroy Hotels. When opened, the hotel will be the second Marriott International property in Hyderabad and the fifth Courtyard-branded hotel in India.

World-Class Golf Course and Convention Centre at Manikonda

A WORLD-CLASS golf course and a convention centre along with a business hotel, villas and residential facilities being built at a total investment of Rs 200 crore at Manikonda in Hyderabad, would be the latest jewels in the crown of Andhra Pradesh.

The State Government had offered about 250 acres for this project. The Government was also willing to provide additional land for the project if necessary. The Andhra Pradesh Industrial Infrastructure Corporation (APIIC) has selected Emmar Properties of Dubai for building an integrated convention centre complex at Manikonda village, adjacent to Indian School of Business.

As per the Government proposal, the convention centre will have a plenary hall which can accommodate about 5,000 people along with breakaway rooms, sophisticated audio-visual equipment, secretarial and exhibition facilities, food courts, cafeterias, restaurants and other support services. The golf course will have a fully equipped clubhouse. A 300-room business hotel would also be constructed here to support the convention centre activities, and the capacity would be increased to 750 rooms based on the potential. The convention centre is estimated to cost Rs 43.7 crore and the business hotel would require Rs 34.3 crore.

Property Rates Spiral Upwards Around Hyderabad...

Hyderabad and its adjoining areas are witnessing unprecedented hike in land prices. As IT companies expand operations away from the city due to space crunch, they are setting up offices in what were once considered far-flung areas in the outskirts of Hyderabad.

Land prices in these outskirts are rapidly accelerating as more and more buyers are being lured by their peaceful atmosphere, infrastructural facilities and easy access to the city due to new roads. The eastern suburbs have marked a record 125 per cent rise in property costs. Inception of the Ring Road project joining Gachibowli with Shamshabad has changed the fate of land stretches near Warangal and Vijaywada Highways since the last few months. Property rates in these areas are also spiralling upwards on the back of news that the Ring Road will cut across all the highways running through the city. Space shortage in central city areas is likely to push up demand for areas like Singapore City (Pocharam).

Not one to lag behind, property prices in the western suburbs have also skyrocketed by more than 150 per cent in the last few years. The main areas here include Hitec City, Gachibowli, Madhapur, Kukatpally and Shankarapally. Improved connectivity between Miyapur and Hitech City due to an over bridge has improved the prospects for areas near Kukatpally.

All localities across the city are benefiting from the spill over effects of the Rajiv International Airport being built at Shamsabad and the proposed Mass Rapid Transit System(MRTS). Areas near Fab City, Hardware Park and those on Warangal and Vijayawada highways are attracting a lot of attention. While land prices in Shamshabad are touching up to Rs 5,000 per sq yard, they have already gone up to Rs 20,000 in Gachibowli, Kondapur and Madhapur. Not to be left behind, land values along the Medchal highway too have touched Rs 8,000 to 10,000 per square yard. The government’s move to replace HUDA with Hyderabad Metropolitan Development Authority (HMDA) by increasing the area under its jurisdiction to 6,852 sq km with the merger of parts of five adjoining districts will only add to the real estate bonhomie.

The northern and southern suburbs have also been bitten by the development bug and prices here have risen by 163 per cent and 100 per cent respectively. Major developmental activities are on in Shamshabad, Medchal Road and between Narsapur Road starting from Jedimetla and Karimnagar Highway. Stretches near Srisailam Road and Shameerpet are also in demand.

Experts opine that things are looking good for investors in property holdings. This is primarily because of two reasons – IT and ITES companies will expand to newer, cheaper locations and the employees of these firms will buy property at these locations as prices here, though high, will still be substantially lower than those in the city.

Demand for property continues unabated as witnessed at the recent auctions held by The Hyderabad Urban Development Authority (HUDA). A prime commercial plot of land adjoining Kasu Brahmananda Reddy Park in Jubliee Hills, auctioned by HUDA was sold for a whopping Rs 3.36 billion. The auction received tremendous response, with 21 bidders participating in it. The winning consortium plans to build shopping malls and a five-star hotel on the land. The auction of a residential land in Jubilee Hills the next day was a major success too. The HUDA auction set a milestone of sorts when a plot at Nandagiri Hills in Jubilee Hills was sold at Rs 80,000 per sq yard, the highest price ever paid during an auction conducted by the Authority. HUDA will use the money raised from the commercial land auction for financing the Outer Ring Road project aimed at decongesting the city. Hyderabad outskirts are set to get a major lift due to this project.

Before You Buy A Property In India

At some point in your life, you may decide to buy a property. Incomplete documentation can mean big trouble. To avoid problems later on, it would be best to go that extra yard to thoroughly check out the piece of property you intend to buy in all possible ways. Right steps ensure a safe and unhindered Purchase of Property.

The real estate boom is in evidence everywhere, but do not lower your guard while buying property. Builders may promise the moon or real estate agents may promise land paved with gold. It is part of their marketing strategy. But to maie a sound choice, it helps to know which legal documents one should be careful about while buying property. It is definitely better if one gets a legal opinion on the documents, but a basic knowledge of legal documents would help an investor in analysing what he or she is buying. It is this veracity of the legal document that will make or mar the ownership of property.

1. The first and the foremost thing that a probable investor needs to do is to physically verify the property. A look at the actual piece of land will give an idea about its good and bad points. This is also true in case of a flat or a building.
But that is not all. One should assess whether the property has individual access from the public road. If so, how big is the road? Many times, the road earmarked in a document may not be physically visible near the property.

2. Another important point is to assess the kind of neighbourhood one would live in. It would benefit the landowner to find out if there are troublesome factors that the real estate agent may not have told him about. Similarly, one should be able to find out whether the area is pleasant and pollution free. "A chicken, duck or goat farm may not constitute a very pleasant neighbourhood, unless one has such interests".

3. Most of us go by the beauty of a place and of course the land value. It would be well worth it to check with the local body if there is any freezing of construction or whether it is a notified area, like a bio-conservation zone, for example. Planning in such a place would require a different perspective.

4. The local bodies would also help in providing information whether there are any plans to acquire any property for expansion of roads or for any other public purpose.If the property is located near any major developing centre, such information would be crucial.

5. Once the location of the place is decided upon, the most important document that a buyer must insist upon is the original title deed and also the past ones extending up to at least 20 years. This is to ensure that the property has not been pledged for a loan in the bank. The Encumbrance Certificates for a minimum period of 30 years needs to be verified to find out if there are any existing encumbrance over the Property. This can be acquired in the concerned sub-registrar office.

6. It would also help if the buyer verifies that the absolute rights of the seller of the property are being transferred to the buyer. The property should also be correctly and completely described with survey numbers, boundaries, building number, measurements and proper description of any amenities. It would be advisable to get a sketch of the property from the village office and attach it to the document.

Power of Attorney document, Death Certificate, Legal Heirship Certificate if any concerning the title to the Property may be verified with the Original for authenticity.

7. After the ownership deed, it is most important to find out whether the seller has any arrears like building tax, property tax, electricity and water charges. The buyer can always insist on seeing the necessary books and bills. This also helps to ensure that the Property stands in the name of the Vendor.

8. While buying a building, insist on seeing the building plan and the completion certificate issued by local body to see that construction has been made as according to the building rules. Call for the documents of title and link documents of the Vendor of the Property and verify the same with your legal advisor. Check whether the building plan has the due approval of the Municipal corporation/ gram Panchayat/ Civic Authority and insist for completion certificate from the Builder/ Developer so as to ensure that there is no deviation in the approved plan.

9. Agreement of sale and deed of sale are to be properly worded with suitable clauses to take care of situations such as default, delivery of vacant possession, payment of Stamp Duty / Registration charges, Compliance of statutory requirements, a clause on indemnity etc to be clearly mentioned. A very clear description of the Schedule of Property is to be emphasised for a good conveyance of the Property.

In case of Purchase of Flat the registration of the undivided share of the land which conveys the title to the Property in favour of the Purchaser is to be insisted upon.



Conveyance / Sale deed:
It is a document by which the title of a property is conveyed by the seller to the purchaser. Conveyance is the act of transferring ownership of a property from a seller to the buyer.

ULC [Urban Land (Ceiling & Regulation) Act]:
The ULC Act is a social legislation vide which the Government has set a limit on the maximum permissible vacant land holding by a single entity in an urban agglomeration. Depending on the location and zone classification, this maximum limit varies from 500 sq. Mts. to 1500 sq. Mts. This excess vacant land is liable for acquisition by the respective State Government. Any vacant land holding beyond this limit would require an exemption under various sections from the ULC authorities, which is governed by the Urban Development (U.D) department. The land may be exempted if the concerned authorities are convinced that by the acquisition of this vacant land there would be undue hardship caused to the owner or if the owner manages to convince the concerned authorities that this vacant land needs to be held in public interest. Other than these reasons, there may be various other reasons, which the authorities may consider to provide exemption to this land.
When such vacant land is sought to be developed for housing schemes, the schemes have to be developed as per the norms and guidelines laid down by the concerned authorities and need to be necessarily sold to beneficiaries who fall under certain specified sections/categories mentioned in the permission.

7/12 Extract:
It is a document, which shows the names of the owners of the property. It contains details such as the Survey numbers, area, date from which the current owner's names were registered as owners. The 7/12 extract is issued by the Tehsildar or the concerned land authorities. Along with this the corresponding record of rights in Form no.6 for last 30 years needs to be obtained

Title certificate:
A Title certificate is issued by an advocate after conducting a search of the title of the property, which is intended to be purchased. The title certificate would state if the property is unencumbered and has a clear marketable title.

Non Agricultural (N.A) permission:
If the land under consideration is agricultural land and if one intends to develop the said land for residential/commercial/industrial use, then such agricultural land has to be converted to non-agricultural land and an N.A order has to be obtained from the Collector of the District where the property is located. Along with this, one needs to take the latest receipts evidencing the payment of N.A. tax. In cases where the conversion from agricultural use to N.A. use is not done within the stipulated period then, there should be an order from the concerned authority extending the period.

Agreement of sale:
All important information regarding the sale is recorded here, such as the area, apartment number, cost of the apartment, mode of payment, tenure of payment and date of possession.

Title deed:
A title deed in your name indicates that the property is indeed yours. And if you ever decide to mortage your property for a loan, you will need to give the original title. Should you sell the property, retain a copy of the sale deed. In fact, every original document concerning the legal title of the property has to be handed over to the new owner. But don't do so unless you make photocopies of each and every single one of them.

Form 37I[No objection certificate under section 269 UL (3) of the Income Tax Act, 1961]:
Any immovable property in certain cities specified by the Appropriate Authority which is transacted above a certain value, needs to obtain a No Objection Certificate from the Appropriate Authority. A transaction would be incomplete and invalid if this clearance is not obtained..

The appropriate authority would issue a No objection certificate, if it feels that the property has not been undervalued. If the appropriate authority feels that the property is undervalued, then it would do pre-emptive purchase of this property and sell it subsequently through an auction/tender. Various transaction limits have been set for various cities.

Stamp duty:
Since stamp duty is levied by state governments on all real estate agreements, it varies from state to state. The amount is dependent on the purchase price that is shown in the agreement of sale. The stamp duty in many states is paid as per the True market value as assessed by the Stamp Office. When an agreement is to be stamped, it needs to be unsigned and undated and after the Stamp Office affixes stamps on the agreement, one may execute the agreement. Stamp duty is to be paid at the time of registration.

Registration:
Registration refers to the recording of the contents of a document with a Registering Officer appointed by the state government. The registration of the agreement has to be done after a fixed period of time from the due date of execution. The date and amount to be paid for registration varies between states.

Fard:
Where a purchase of agricultural land is concerned, all details regarding ownership, quantity of land, mortgage of land, if any, and details on who is cultivating the land is mentioned in a document called Fard. Obtain the latest copy of Fard from the seller. Once the sale deed has been executed in your favour, apply for a new Fard in your name after meeting the concerned Patwari of the area. Make sure that the new Fard contains your name as the owner and cultivator.

When you are buying a property, wear the shoes of a seller for a second and just think about how the buyer market would be if you have to sell it for some reason at some point in future. This helps in the rough estimation of return on investment.

New Special Economic Zones (SEZs) / IT Parks at Hyderabad

The Board of Approvals of the Ministry of Commerce today approved ten new Special Economic Zones (SEZs), including six in private sector in the Information Technology Sector in Andhra Pradesh.

These product-specific SEZs were cleared by the Board of Approvals of the Ministry of Commerce on Friday. Andhra Pradesh enjoys the distinction of having the highest number of proposals cleared by the board, according to a press release issued by K. Ratna Prabha, Secretary, IT and Communications.

Two others were sanctioned at Nanakramguda in Hyderabad. Four private IT and ITES SEZs were also approved in Serilingampally and one in Qutbullapur mandals of RR district.

Private players involved in these ventures are Satyam Computer whose three projects were cleared at Qutbullapur, Kapulauppada and Serilingampally. CA Computer Associates India, AP Techno Projects and K. Raheja IT Park were three others permitted at Serilingampally.

Ms. Prabha said the board earlier had approved two Government SEZs at Mamidipally and Poppalaguda in RR district. The Mamidipally project was sanctioned over 552 hectares and had an employment potential of one lakh jobs.

Wipro Technologies and K. Raheja IT Park had been sanctioned in the private sector at Manikonda and Pocharam villages of RR district. The old and new SEZs will have not less than 135 lakh sq. ft. of processing area and generate direct employment for 3.42 lakh persons.
